Another company (our competition) used an ad, we have built / done is this legal?

My husband and I have just started a monthly magazine. Someone using an ad that we were doing. Our magazine had no legal info or a © symbol in it. This was our one: e questions. Unfortunately this is not something I was thinking. We are just beginning, and we have no legal services yet. On top of all this, the company has spent millions of dollars and an in-house art department that could have developed it for them.

Was this ad for one of your advertisers? If you were paid to create it (or even if it happens as part of their advertising contract with you) property rights usually belong to them. They can do with it as they want, even use it in a competing magazine. This is usually the case when an advertising company creates an ad for a client. The point of it. Why would a customer pay for something if they do not have control over it?
